Petition, Lobbying and Request

Petition

A petition is the constitutional right. provided by the constitution and any person is able  to make a petition voluntarily  to the authorities ; state organization and  local municipal entity and a prerequisite for petition must be accompanied by introduction from  at least one member of the city council. The city council in receipt of the petition should conduct evaluation and draw a conclusion whether the petition will be accepted or not.   If accepted,  the city council will distribute the petition to relevant organs concerned and make an effort to realize the intention of petition.  The executive bodies that received the accepted petition from the city council should carry out their assignment faithfully, however it is not necessarily correspond to  the intention of petition without obligation.  The matters that state and municipal entity have authority will be subject to a written opinion and resolution made by the executive bodies.

Lobbying / Request

Lobbying  the authorities it State organization or Municipal  entity is regarded as a same action as that of  petition . in terms of making a request.While the right of petition is guaranteed by the constitution,  and its procedure is written clearly in accordance with the law,  lobbying is not  stipulated by law, therefore, procedure of  lobbying   for submission to the authorities are ordinarily quite simple. A memorial  submitted to the city council will be summarized and copied for distribution to each parliamentary group together with other reporting requirements for all city council members.

Observation

The gallery section has been set up in the assembly hall providing 56 seats and spaces for 2 wheel chairs so that citizens can directly see and hear proceedings of the city council. Citizens who want to observe proceedings on the day of plenary meeting need to write down " Name and Address "  in the register book. After that, tickets for observation are given to them for entry..    For observation on the committee meeting,  citizens need to write down " Name and Address "  in the register book , then obtain permission from Chairman for entry.( 12 gallery seats are provided. ) .

 

Direct petition from residents

A system has been established as a means to voluntarily present resident’s opinions with the aim of  correcting negative effect of representative democracy for local administration in which residents can participate through election.

Direct petition will become valid with countersignature by constituents of definite number and direct petition  should be made by a representative of constituents, not by a resident individually. The procedure for direct petition is stipulated by the Local Autonomy Act, for example, direct petition for establishment, amendment, or deletion of municipal ordinance requires countersignature more than fiftieth of constituents.  Mayor who accepted direct petition should  summon the city council within 20 days and submit the petition with his opinion to a city council. 

The conclusions of discussion in the city council should also be announced officially.
